Welcome to Party PLANit. These Terms & Conditions (“Terms”) govern your use of the Party PLANit website and certain services and communications provided by Party PLANit (“Party PLANit,” “we,” “us,” or “our”).
By using our website, submitting an inquiry, or voluntarily using services subject to these Terms, you agree to these Terms as applicable to your interaction with Party PLANit.
Certain Party PLANit services may also be governed by a separate proposal, contract, rental agreement, event agreement, release, invoice, or other written agreement. If a separate written agreement contains terms that conflict with these Terms regarding the specific service covered by that agreement, the terms of the specific written agreement will control for that service.
1. Party PLANit Services
Party PLANit provides event-related products and services that may include event planning, consultation, coordination, event design and décor, rentals, photo booth experiences, special event experiences, and related services.
Information provided on our website is intended to provide general information about Party PLANit and our services. Availability, pricing, packages, inventory, and service offerings may change and are not guaranteed until confirmed through an applicable booking process or written agreement.
2. Event Bookings and Agreements
Submitting an inquiry, requesting information, or participating in a consultation does not by itself reserve an event date or guarantee the availability of any Party PLANit service or rental.
Event services, rentals, payment requirements, cancellations, rescheduling, damage responsibility, setup, breakdown, and other event-specific terms may be governed by the proposal, contract, invoice, or other agreement applicable to that booking.
3. Website Use
You agree to use the Party PLANit website only for lawful purposes and in a manner that does not interfere with the website, its operation, or the rights of others.
Website content, including text, graphics, photographs, logos, designs, and other materials owned by Party PLANit, may not be copied, reproduced, distributed, or used for commercial purposes without permission, except as otherwise permitted by law.
4. Photo Booth SMS/Text Messaging Program
Party PLANit may provide guests using a Party PLANit photo booth with the option to receive photographs or other requested photo booth content by SMS/text message.
Participation in the SMS photo-delivery service is voluntary.
When SMS delivery is available, a guest who chooses to receive a photo by text will be presented with an SMS consent disclosure before entering a mobile telephone number.
The SMS consent disclosure screen states the following:
"GET YOUR PHOTO BY TEXT
Want your photo sent directly to your phone?
By continuing and entering your mobile number on the next screen, you agree to receive text messages(s) from Party PLANit containing the photo(s) you request from this photo booth.
Message frequency varies based on the number of photos requested. Message and data rates may apply.
After receiving your text, reply STOP from your mobile phone to opt out or HELP for assistance.
Your consent is for photo delivery only and does not authorize unrelated marketing text messages.
Our Privacy Policy and Term & Conditions are available at the photo booth upon request."
By affirmatively agreeing to the disclosure and providing a mobile number, the guest consents to receive text message(s) from Party PLANit for the purpose of delivering the photograph(s) or related photo booth content requested by that guest.
Consent to receive photo booth text messages applies to the requested photo-delivery service and does not constitute consent to receive unrelated marketing or promotional text messages from Party PLANit.
5. SMS Message Frequency and Charges
Message frequency varies depending on the number of photographs or other photo booth content you request.
For example, requesting additional photographs by SMS may result in additional text messages.
Message and data rates may apply. Your wireless carrier's standard messaging and data charges may apply depending on your mobile service plan.
Party PLANit does not charge a separate fee for receiving your requested photo by SMS unless otherwise disclosed.
6. SMS Opt-In
When the I AGREE - CONTINUE button is selected on the consent screen on the photobooth, the guest will Opt-In to receiving text messages from Party PLANit, which will trigger the START, UNSTOP, YES keywords to begin text messages. Text messages will not be sent from Party PLANit without the guest selection of I AGREE - CONTINUE.
7. SMS Opt-Out
You may withdraw your consent to receive SMS messages from the applicable Party PLANit messaging program at any time.
To opt out, reply STOP to a Party PLANit text message.
After you opt out, you may receive a final confirmation message indicating that your opt-out request has been processed. No further messages associated with that messaging program will be sent to that mobile number unless you subsequently provide appropriate consent to receive messages again.
8. SMS Help
For assistance, reply HELP to a Party PLANit text message.
You may also contact Party PLANit using the contact information provided at the end of these Terms.
9. Mobile Number Responsibility
When providing a mobile telephone number to Party PLANit, you represent that you are authorized to use or provide that number for the requested service.
You are responsible for entering the correct mobile number when requesting delivery of photo booth content.
Party PLANit is not responsible for content delivered to an unintended recipient because an incorrect mobile number was entered by the user.
10. SMS Delivery
Delivery of SMS/text messages depends on mobile carriers, networks, devices, and other technology outside Party PLANit's direct control.
Party PLANit does not guarantee that any text message or photo will be delivered within a particular period of time or that every attempted message will be successfully delivered.
Wireless carriers are not liable for delayed or undelivered messages.
11. Privacy
Your privacy is important to us.
Our collection, use, and protection of personal information, including mobile telephone numbers and SMS consent information, is described in the Party PLANit Privacy Policy.
Party PLANit does not sell, rent, or share mobile telephone numbers, SMS opt-in information, or SMS consent with third parties or affiliates for their own marketing or promotional purposes.
Information may be provided to service providers acting on our behalf when reasonably necessary to operate or support the requested service, including transmitting requested photo booth content.

12. Photographs and Event Media
Party PLANit may provide photography, photo booth, or other event media services.
Receiving a photograph through the Party PLANit SMS photo-delivery service does not by itself grant Party PLANit additional rights to use a guest's image for marketing or promotional purposes.
Any applicable permission concerning Party PLANit's use of photographs, videos, or other event media for promotional or marketing purposes may be addressed separately through an event agreement, release, consent process, or other applicable terms.
13. Third-Party Services
Party PLANit may use third-party service providers and technology platforms to operate our website, process transactions, manage events, provide communications, transmit SMS messages, deliver photographs, and provide other business services.
Your interaction with certain third-party services may also be subject to the terms or privacy policies of those providers.
14. Intellectual Property
Unless otherwise indicated, the Party PLANit name, logo, website content, graphics, designs, written materials, and other original content are owned by or licensed to Party PLANit and are protected by applicable intellectual property laws.
Nothing in these Terms grants a user ownership of Party PLANit's intellectual property.
15. Disclaimer and Limitation of Liability
Party PLANit strives to provide accurate website information and reliable services; however, website content and technology-dependent services may occasionally contain errors, experience interruptions, or become temporarily unavailable.
To the fullest extent permitted by applicable law, Party PLANit will not be responsible for indirect, incidental, special, or consequential damages resulting solely from use of or inability to use our website or technology-dependent communication services.
Nothing in these Terms limits any rights or remedies that cannot lawfully be limited.
16. Changes to These Terms
Party PLANit may update these Terms periodically to reflect changes in our services, business practices, technology, or applicable requirements.
When these Terms are updated, the effective date at the top of this page will be revised.
Your continued use of applicable services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
17. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise.
